Abstract

In the Credit Agricole Bank Polska Judgment, the CJEU confirms its previous case law on the interpretation of the defendant's domicile as a criterion of jurisdiction in favor of the courts of the last known domicile in a Member State, when his current whereabouts are unknown. However, the appointment of a a representative in absentia to continue the proceedings does not imply the appearance of the defendant, who is in default, which has consequences for denying the jurisdiction based on art. 26 of Brussels I bis and also a material defenselessness for the purposes of art. 45.1º.b) of the same Regulation
