Résumé

The insurance market does not remain indifferent to the advances of new information technologies, automation and the artificial intelligence (AI). The use of automatic decision systems or «robo-advisors» and their various technical applications constitutes one of the topics of our time. «Robo-advisors» are automated processes or systems of action, based on computer algorithmic formulas and logical decision trees, without relevant human intervention. Its functionality is not limited to the activity of advice and can also reach management and decision-making areas, in more or less complex scenarios. Understood in this way, the result of this type of process will be a «digital act» arising from the algorithmic calculation in contrast to the «human act» as it has been understood until now and on which the category of act of law or «legal act» itself has been built, as a product of the conscious and external will of a human being.
