Abstract

Our Constitution protects the right of all citizens to decent housing. However, an important part of the citizenry has serious difficulties in achieving this objective, such as the case of young people in accessing their first home or a good number of vulnerable families whose economies are not enough to own a home or pay for a leasing under current market conditions. It is the responsibility of the different Public Administrations to ensure compliance with this right with all guarantees, as wll as other basic rights such as health or education. In this 2ork w try to analyze whether the new Housing Law also protects the rights of the landlord, specifically, the one who is not a large landlord whose income from these rentals may be essential for his economic relief, the burdens that it entails putting on the market, rental of a home and the right to effective judicial protection in the event of non-payment by the tenant.
