Résumé
On January 15, 2021, the Spanish Supreme Court has established the first ruling that directly addresses the position of the shareholders who have exercised their right of separation in a company that subsequently opens an insolvency proceeding, and the consideration it should deserve their reimbursement. The decission of Supreme Court addresses great interest issues such as the moment when membership is lost and the category of the reimbursement credit, among others
