Abstract
Among the procedural and organizational measures to deal with COVID-19 in the area of the Administration of Justice, has been included the preferential of telematic presence in the different procedural formalities. The possibility of intervening by videoconference has a sufficient normative basis in our system, but a more complete regulation is required ir order to introduce legal certainty in practice. This paper deals with the study of the background and current status of this issue, as well as some of the critical points for this purpose, such as the technical requirements; the criteria for selecting the actions to be performed in virtual format; the guidelines for the practice of the evidence; the ways to guarantee publicity, confidentiality and protection of personal data; and other relevant aspects for its adequate preparation and development.
