Resumen

En un contexto marcado por la creciente importancia estratégica de los datos, la industria financiera se enfrenta al importante desafío de conseguir salvaguardar sus ventajas comparativas sin comprometer, a su vez, la privacidad de los datos personales de sus clientes ni impedir que terceras partes puedan ejercer su legítimo derecho de acceso a los mismos. Se trata de un escenario complicado en el que, con independencia de las actuaciones que puedan emprender dichas entidades, resulta también necesario contemplar ciertas dosis de intervención pública. Entre otros aspectos, esta deberá orientarse no solo a garantizar que imperen unas reglas de juego equilibrado dentro del sector, sino que, además, se dirigirá a encontrar las fórmulas prácticas más convenientes para sacar el máximo provecho de la información digital disponible de cara al mejor desempeño de las funciones de regulación y supervisión que son propias de las autoridades
