Abstract
Throughout this work we analyze the interpretation that the Palencia Provincial Court makes regarding the possibility of requesting the nullity of a ground clause and then claim the reimbursement of the unduly paid amounts through a subsequent process. This matter affects procedural concepts such as the issue, comprehensiveness, the estoppels or the extent of the concept res judicata. The confusion that exists regarding this matter is shown by the change of criteria and the return to the previous one in only five months and the dissenting vote of most of the Magistrates, that is repeated in the subsequent judgements.
