Abstract

This paper analyzes the reform of the Civil Procedure Law as a consequence of the transposition of the Directive 2014/104/EU into Spanish law. That regulatory reform introduces a new section in the Civil Procedure Law with 11 articles, apparently trying to take into consideration the litigation peculiarities in competition law. The author maintains that, as in the directive itself, what these new precepts show is the concern over the possibility that private enforcement in this issue could endanger the leniency programs.
