Abstract
The current LEC contemplates, in its article 248, two procedures, namely: ordinary declarative and verbal, while, respectively, articles 249 and 250 LEC, prescribe the claims that, due to the subject matter (preferably) and the amount must be processed through each of the ordinary procedures. For its part, Book IV LEC regulates special procedures. Ordinary procedures with procedural specialties constitute a third category of procedures. The eviction trial for non-payment of rent and similar amounts is configured as an ordinary declaratory procedure with specialties, dispersed throughout the LEC. The accumulation of claims constitutes a procedural specialty of the eviction trial, raising doubts about the viability of the accumulation of the eviction action for non-payment of rent and other amounts and the compensation action for damages to the property.
